The orders, granted on October 29, 2026, by Justice Biomdo, prohibit Nyaga from selling, transferring, disposing of or otherwise dealing with the properties as the court determines the recovery suit filed by the anti-graft agency.
The commission is seeking to recover KSh111,577,188.75, which it alleges was irregularly acquired from the Embu County Government through business transactions involving companies associated with the MCA.

According to the EACC, investigations established that Nyaga traded with the county government through five companies in which he allegedly had interests, creating a conflict of interest.
The companies named in the suit are Truco Enterprises Ltd, Peanco Ltd, Njewaco Ltd, Hasoco Ltd and Hiwco Ltd. The commission also sued Isaac & Timothy Company Ltd, bringing the total number of companies named in the proceedings to six.

The EACC filed the recovery suit on August 28, 2026, against Nyaga and the six companies, seeking to reclaim the funds allegedly obtained through the transactions.
Investigators further established that part of the money was allegedly used to acquire a parcel of land identified as Mbeti/Kiamuringa/49, registered under Isaac & Timothy Company Ltd.
Six motor vehicles were also identified as assets linked to the funds under investigation. They include registration numbers KDD 932H, KDC 857D, KDL 451F, KCQ 172W, KHMA 624H and ZF-9309.

To preserve the properties while the case proceeds, the court directed the Land Registrar and the National Transport and Safety Authority (NTSA) to place restrictions against the land and vehicles, preventing their transfer, leasing or encumbrance.

The preservation orders are intended to ensure that the assets remain available should the commission succeed in its recovery case.
The matter now places the MCA and the companies named in the proceedings under scrutiny over allegations of conflict of interest in dealings with the county government, although the allegations remain subject to determination by the court.
